Necessity of updated Mayors Permit when transacting with the government this early quarter of the year.
Under RA 9184's IRR, section 8.5.2. all bidders shall upload and maintain in PhilGEPS a current and updated file of the following Class “A” eligibility documents and one of which is Mayor’s/Business Permit or its Equivalent Document.
RA 9184's IRR Section 23.1. says in cases of recently expired Mayor’s/Business permits, it shall be accepted together with the official receipt as proof that the bidder has applied for renewal within the period prescribed by the concerned local government unit, provided that the renewed permit shall be submitted as a post qualification requirement in accordance with Section 34.2.
Following trail in section 34.2., it says that within five (5) calendar days from receipt by the bidder of the notice from the BAC that the bidder has the Lowest Calculated Bid or Highest Rated Bid, the bidder shall submit to the BAC its latest income and business tax returns, and other appropriate licenses and permits required by law and stated in the Bidding Documents. Failure to submit any of the post-qualification requirements on time, shall disqualify the bidder for award.
This would mean that:
1. There is necessity to inform the bidder of the notice from the BAC that the bidder has the
lowest calculated bid;
2. All eligibility documents including the renewed mayor's permit in particularity shall be submitted
together with post qualification report; and
3. The reglementary period to submit all post qualification report with requirements and documents
together with the mayor's permit or its equivalent is within 5 days from receipt by the bidder of the
notice from the BAC that the bidder has the lowest calculated bid(supra) obviously after bid
opening and seemingly prior bid award.
Service providers who wish to transact with the government at this early quarter must take note.
